During the month of May, the New Castle County Division of Police partnered with the Delaware Office of Highway Safety (OHS) for the Preventing Roadside Deaths Enforcement Campaign, an initiative focused on enforcing Delaware’s Move Over Law and improving roadside safety.
Delaware’s Move Over Law protects more than police officers, firefighters, and emergency medical personnel. The law also applies to DelDOT vehicles, tow trucks, utility vehicles displaying flashing amber or amber-and-white lights, and stationary vehicles displaying warning signals such as hazard lights, road flares, traffic cones, or caution signs.
📖 Under Delaware Title 21, Section 4134, drivers approaching a stationary vehicle displaying a warning signal are required, when it is safe to do so, to move into a lane not directly adjacent to the stopped vehicle.
If changing lanes is not possible or would be unsafe, drivers must proceed with caution and reduce their speed. On roadways with a posted speed limit of 50 mph or higher, drivers must slow to at least 20 mph below the posted speed limit while passing the stationary vehicle.
As a result of the May enforcement campaign, New Castle County Police officers issued 45 citations for Move Over Law violations.
The Move Over Law is designed to protect those working or stopped along Delaware’s roadways. Drivers are reminded to remain alert, move over when possible, and slow down when approaching a vehicle displaying warning signals.
The New Castle County Division of Police thanks the Delaware Office of Highway Safety for its continued partnership and shared commitment to keeping Delaware’s roadways safe.
